How Did We Get Here?

In 2022 the real owner of the building in New Century, my father and best friend, suddenly passed away. I have been able to keep his business running for two years and was able to find a buyer. That is where the issues started...

Leasing Arrangement

All of the buildings at New Century Air Center are on a ground lease. The general idea is that you pay to build a building, you are able to use it for an extended period of time, in my case until 2066, then New Century Air Center takes possession of the building. During the lease you pay for the land. In my case that is around $1,200 per month.

What Is The Issue?

There is a condition in the lease that says anytime that the building is sold, the airport commission must agree to transfer the lease to the new buyer. This has happened 2 times in the history of the lease without any issues. This time there was an issue...

Enter Bryan Johnson

Bryan became executor of the Johnson County Airport Commission in August of 2023. In his linkedIn he touts his skills in "Property / Lease Negotiation" — a "skill" he is attempting to use on me. When I went to the Airport Commission to get consent to assign the lease to the prospective buyer, I was sent the amendment (see below). I was told it must be signed in order for the lease to be transferred to the prospective buyer. I know what you're thinking, he must be leaving something out! I have attached the base lease with all of the amendments up until this point to ease your suspicions!

If you are a lawyer and you took a few minutes to look at this you would see that this is a clear attempt at extortion and that the complete disregard for a lease or contract in place is alarming. I would think twice about signing a lease with New Century and I would not speak to Bryan Johnson without a lawyer present!

    New Century Air Center responds to my request for lease assignment stating that they will only assign the lease if I agree to amend the lease allowing for a rent adjustment from $1,200 -> $17,000 per month.

  • Lease Change Notification

    I was notified by Mr. Johnson that my lease was going to be changing. Apparently I don't have to sign anything. Bryan Johnson's position seems to be that any lease, contract or service agreement can be altered at any time. Note, this also violates an agreement that they signed with my bank. It is likely that the note will be called on the property due to this new stance.

  • My Attorney and I met with Bryan and Cynthia

    Bryan and Cynthia refused to talk about anything in the lease. Instead, they only wanted to talk about the business aspects of the transaction. My perspective on this issue is that agreeing to a $15,000 a month rent increase is bad business.



  • Notification Of Suit

    Unfortunately, I had to send Mr. Johnson notice that if they refuse to assign the lease without a massive rent increase, I will file a suit against the county. I apologize to my fellow residents. This is not how our tax dollars should be spent!
